Terms and Conditions

These Terms and Conditions govern your use of the Blackcat wheels service and website. Blackcat wheels is legally registered company in Switzerland under IDE/UID: CHE-320.920.141

By visiting the Blackcat wheels (website: https://blackcatwheels.ch) you accept, and agree to the content of these Terms and Conditions. We reserve the right to change the Terms and Conditions at any time and it is your responsibility to check regularly before ordering. This does not affect your statutory rights.

Terms of Service

By placing an order via our website, you as a buyer offers to purchase a product which is a subject to the following terms and conditions.

In order to contract with Blackcat wheels you must be over 18 years of age. Blackcat wheels retains the right to refuse any request made by you. If your order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. This will usually be Blackcat wheels or may in some cases be a third party. Where a contract is made with a third party Blackcat wheels is not acting as either agent or principal and the contract is made between yourself and that third party and will be subject to the terms of sale which they supply you. 
When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card, or bank account used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of international products and services may fluctuate. All prices advertised are subject to such changes.

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or 3rd party circumstances for which we will not be responsible.

We do our best to ensure availability of all advertised products and endeavor to dispatch all parts within the quoted time. If there is a delay we will inform you of this via email and the product will be dispatched as soon as it is available. If you have ordered multiple items they may arrive separately.

Our Contract

When you place an order for wheel's components or already built wheels, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. Blackcat wheels retains the right to accept or reject this offer before processing the order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us, the prices have been verified, and the order has been processed and dispatched. A second email will be sent confirming these arrangements.

When you place an order to build custom wheels, you will receive in addition a quotation which you will need to approve in the system. Approved quotation is a binding contract which triggers the start of the work. There will be no pre-payment, unless it's specifically agreed between Blackcat wheels and you as a buyer. Once wheels are ready you will receive an invoice with payment details. After the payment is made and received by us, wheels will be shipped.
Before quotation is approved by you acting as a buyer, order can be cancelled by you free of charge. However, after the quotation is approved by you, it is not possible anymore to cancel it free of charge. The cancellation fee is 60% of total quotation value. After your payment, work is cancelled and no goods are dispatched. 

Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Where applicable, prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Amount'.

The website may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fulfill any orders that you may place based on information on the website that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.

Fair Purchase Policy

At Blackcat wheels, we buy from our suppliers with an agreement to sell to our private customers. It is not in our business model to sell items in bulk quantities to other retailers or bicycle manufacturers. We reserve the right to refuse or cancel any orders which we suspect are beyond the requirements for an individual or club arrangement. Dispute Resolution

Product Specifications and Suitability

Published product details, specifications and suitability information is the best available at the time. Blackcat wheels shall not be held responsible for the accuracy of any advice given regarding the suitability (or otherwise) of any part/s required for the repair of an item. If you have ordered an item that has an unsuitable product description we will remedy this by providing you a full refund upon the return of the item. Please see our Delivery and Returns page for details.

We encourage you to ensure all spare parts are fitted by a competent person in accordance with manufacturer specifications. Blackcat wheels cannot be held liable for any damage caused by the fitting of a spare part.

Please ensure that you have read your warranty conditions before attempting to install a part or otherwise repair item. Blackcat wheels cannot be held responsible if the item is damaged or your warranty is voided. Some manufacturer guarantees may be on condition that you use a qualified cycle technician.

Wheels, wheel building and warranty

All wheels provided by Blackcat wheels have an intended and limited purpose, if they are used outside of that purpose, the wheels will not be guaranteed, the warranty is void and Blackcat wheels cannot be held responsible for any damage or injury that may occur due to misuse. It is up to the user to prove that any defects are manufacturing defects or a fault of Blackcat wheels. It is the wheel user’s responsibility to examine the wheel(s) on a regular basis to determine the need for service or replacement. 

Not covered under this warranty are the following:

• Wheels that have been modified, neglected or poorly maintained.
• Wheels where improper brake pads have been used (especially carbon rims)
• Wheels that have been jet washed or hosed forcefully.
• Wheels that have been damaged in shipping.
• Wheels that have been used for turbo training, racing, competition, polo/trials/stunt riding or for commercial use.
• Wheels improperly installed or improperly repaired.
• Personal injury or damage from causes such as a user’s lack of skill, judgement, use of incorrect tools, competence or experience.
• The finish or aesthetics of the wheels are not covered under this warranty.
• Any labor costs associated with the removal, replacement or reassembly of the product.
• Normal wear to the product. Components may have symptoms of wear in less than 6 months depending on amount of use, type of use and other conditions such as terrain, weather, rider weight and accidents etc. This includes marking / jamming of alloy freehub bodies by steel cassettes. This includes products that have reached the end of their normal life expectancy.
• Please note that it is Blackcat wheels workmanship that is covered here and we are not responsible for any warranty costs involved in any defects which may arise in any components in normal use. Within their manufacturer’s guarantee period, these components should be returned to the manufacturer but it is up to the customer to make the decision to pursue a warranty claim and pay any costs involved.

Governed Law

Blackcat wheels Terms and Conditions shall be governed by and construed in accordance with Swiss Law. Disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Swiss courts.

A product purchased from Blackcat wheels can be returned only if there is:

• Manufacturer issue
• Build failure or error
• Difference in specification vs what was agreed during order or quotation 
• Product failure during warranty

In all above cases, except "Product failure during warranty", items upon previous agreement with Blackcat wheels must dispatched back within 14 days from the original date of items receipt by you.
Costs of returns are covered by Blackcat wheels only if claim is approved followed by our inspection. Otherwise all the costs remain on you, the buyer side.
Products cannot be returned to us after your purchase from any other reason than stated above.

Reviews and Comments

We encourage you to leave reviews, comments and product questions on our website. We regularly monitor this content and we reserve the right to remove, reject or edit it at any time. When submitting information to our website as a review, product question or customer comment you understand that what you have submitted is not copyright protected and you are permitting its appearance on the Blackcat wheels website.

Liability

We shall not be liable for incidental or consequential damages or expenses. This includes, but is not limited to, damage to property, lost income, profits, economic or commercial losses and third parties claims.

This warranty does not affect your statutory rights.

Privacy, Copyright and Disclaimer

We will never sell or pass on your name and address to any other organization without your consent. Your details are confidential and you will never receive unsolicited mail as a result of ordering from Blackcat wheels.

Blackcat wheels Store maintains a strict privacy policy which is based on ECWID and google, google blogger solutions.

We expect you to maintain the confidentiality of your username and password for your Blackcat wheels account.

All content included in this site, text and graphics (including copyright), is owned and controlled by Blackcat wheels. In accessing the Blackcat wheels web pages, you agree that you may only download the content for your own individual and non-commercial use.
